Cap. 2: Member Exclusive Regulation
Part I
Preliminary
1. Short Title
This regulation may be cited as the Member Exclusive Regulation.
2. Interoperation
In this regulation, unless the context otherwise requires—
adjudicator (裁決者) has the same meaning as in the Adjudication Act (Fundamental Rule Cap. 7);
member (會員) means users approved into the group;
non-members (非會員) means any person who is not a member;
group (群組) means the Hong Kong Aviation Forum Facebook group;
content (內容) means texts, photos, videos, documents, links, codes transmitted in any forms;
moderator (版主) has the same meaning as in the Moderator Act (Fundamental Rule Cap. 3).
Part II
Share of Content to Non-Members
3. Share of content to non-members
(1) Any person who shares group content shall be guilty of a rule violation and is liable on conviction upon indictment to removal from the group.
(2) It is a defence to a charge under subsection (1) that—
(a) the defendant is authorised by the original poster or the copyright owner to repost the content;
(b) the repost has provided the source, including the name of the original poster and the Hong Kong Aviation Forum which the repost is desirable to the interest of the Hong Kong Aviation Forum;
(c) the content is used by social media managed by the Hong Kong Aviation Forum.
(3) In this section—
group content (群組內容) means content that—
(a) is posted in the group; and
(b) the content is not reposted by the original poster to other public online platforms apart from the group, which the original poster is—
(i) the copyright owner; or
(ii) is authorised by the copyright owner to share the content.
original poster (內容擁有者) means the person who posted the content;
copyright owner (版權擁有人) has the same meaning as in the Copyright Ordinance (Cap. 528).

4. Appeal
(1) Appeal against a conviction, are requested through—

(2) Where an appeal was received, the adjudicator could issue a Suspension Order to temporarily suspend the penalties from enactment.
