Subsidiary Rule of Fundamental Rule Cap.2 Special Power Act

 

A. Approval of Post Regulation

(Made by the Acting Head Administrator under section 3 of the Special Power Act (Fundamental Rule Cap.2))

[17 June 2021]

1. Commencement 

This Regulation comes into operation on 17 June 2021.

 

2. Interpretation 

In this Regulation —

Common Rule (普通規則) means all common rule in operation;

Head Administrator (管理員) means the Head Administrator of the Hong Kong Aviation Forum;

Moderator (版主) means the moderator of the Hong Kong Aviation Forum;

Administrators (管理團隊) means the Head Administrator and any Moderator of the Hong Kong Aviation Forum;

Cap.1 (《一般規則》) means the General Rules Regulations (Common Rule Cap.1);

post approval (貼文檢查) means only posts that are approved by the administrator can appear in the group;

rule violation (犯規) means the contravene of Common Rule;

content (內容) means texts, photos, videos, documents, links, codes transmitted in any forms;

original poster (內容擁有者) means the person who posted the content;

group (群組) means the Hong Kong Aviation Forum Facebook group.

 

3. Direction for activation of post approval requirement

(1) The Head Administrator may issue a direction to activate the post approval requirement for a period specified in the direction.

(2) Pursuant to the direction issued under subsection (1), all posts made within the Hong Kong Aviation Forum are subject to mandatory approval by any administrators before release.

(3) The period specified in the direction issued under subsection (1) must not exceed 1 year.

(4) Any direction issued under subsection (1)—

(a) must be announced in the release centre; and

(b) is not a subsidiary rule.

(5) The Head Administrator may revoke the direction issued under subsection (1) before the specified period expires.

(6) The administrators may, at their sole discretion, pre-approve posts made by any member.

(7) The pre-approval privilege granted to a member may be revoked or modified by the administrators at any time without prior notice and is final and not subject to appeal.

 

3A. The post of content to be refused in particular circumstances 

The post approval need not to be approved if it appears to the administrators that there are reasonable grounds for believing that the content has committed a rule violation. 

 

3B. Review of refusal of post

(1) Where the administrators has refused to approve the post, the original poster may apply a review to the refusal of post to an adjudicator of first adjudication.

(2) On the hearing of an application under subsection (1), an adjudicator may confirm or revoke the decision of the administrators.

 

4. Exclusion of post approval as penalty

When a post approval requirement is active, the post approval penalty specified in the Level of Penalty as in section 17(2) of the General Rules Regulations (Com. Rule Cap. 1) is excluded.
