HONG KONG AVIATION FORUM FUNDAMENTAL RULE 

Cap. 5: Rule Revision Regulation

 

 

1. Short Title

This rule may be cited as the Rule Revision Regulation.

 

 

2. Interoperation  

In this rule, unless the context otherwise requires —

Group (群組) means the Hong Kong Aviation Forum Facebook group; 

Motion (動議) means the proposal, amendment and cancellation of any rule;

Head Administrator (管理員) means the Head Administrator of the Hong Kong Aviation Forum;

Moderator (版主) means the moderator of the Hong Kong Aviation Forum;

Rule (規則) means the Common Rule and Fundamental Rule of the Hong Kong Aviation Forum;

Announcement (宣布) means a message released via Hong Kong Aviation Forum Release Centre;

Member(s) (會員) means user approved into the group;

Administrators (管理團隊) means the Head Administrator and any Moderator of the Hong Kong Aviation Forum;

Amendments (修訂) means any changes to the rule including proposal, amendment and cancellation;

Rule revision adjudicator (規則審視裁決者) means the member who operates and makes a verdict on the rule revision;

Terms and Conditions (條款) means the Terms and Conditions of the Hong Kong Aviation Forum;

Privacy Policy (私隱政策) means the Privacy Policy of the Hong Kong Aviation Forum;

Law (法律) means the Laws of the Hong Kong Special Administrative Region.

3. Powers 

 

A. The rule revision adjudicator can grant leave to a Rule Revision when an administrators’ action or rule amendment —

(a) violated the Terms and Conditions; or

(b) violated the Privacy Policy; or

(c) a Common Rule has violated the Fundamental Rule; or

(d) has violated the Law; or

(e) is irrational.

B. Reliefs of a Rule Revision

(a) Mandamus Order

Adjudicators could issue a Mandamus Order compelling the Respondent to perform a specific act.

(b) Certiorari Order

Adjudicators could issue a Certiorari Order to quash or set aside a decision already made by the Respondent.

(c) Prevention Order

 Adjudicators could issue a Prevention Order to prevent the Respondent from acting or continue to act in excess of their power.

(d) Declaration

Adjudicators could declare the rights and duties of parties according to the rule.

(e) Prohibition Order

Adjudicators could issue a Prohibition Order to restrain any person from acting in which they are not entitled to act.

4. Proposal of Rule Revision

 

All members could propose a Rule Revision via —

5. Judgement

The judgement of the Rule Revision will be uploaded to the Hong Kong Aviation Forum website for future references.

An appeal can be requested to our administrators via —
